We transfer your personal information to third-party service providers (Data Processors) that perform essential services on our behalf, such as IT, data storage, marketing, and communication management.

Our primary Data Processor is GoHighLevel (HighLevel Inc.), which provides our CRM and communication platform. We use contractual means (Data Processing Agreements) to ensure these third parties protect your data to a comparable standard as required by B.C. PIPA.

4. Storage and Processing Outside of Canada

🚨 IMPORTANT NOTICE REGARDING DATA STORAGE

ClearLand.ca uses GoHighLevel as our Customer Relationship Management (CRM) and communication platform. Your personal information collected through our CRM, including contact details and communication records, will be stored and processed on servers located in the United States of America (USA).

Impact of Foreign Jurisdiction: By using a service provider with servers outside of Canada, your personal information is subject to the laws of that foreign jurisdiction. This means your data may be accessible to courts, law enforcement, or national security authorities in the USA.

Our Commitment:

We have chosen a reputable third-party service provider (GoHighLevel) and rely on their security infrastructure.

We require our provider to use safeguards such as encryption of data in transit and at rest, and adherence to robust security standards.

GoHighLevel is certified under the EU-U.S. Data Privacy Framework (DPF). While this is primarily for European data, this certification provides additional assurance that our service provider adheres to a set of privacy principles designed to protect your personal information when transferred to the USA.

ClearLand.ca remains accountable for the protection of all personal information stored on their platform, as required by PIPA.

By providing your personal information, you consent to the storage and processing of your data in the USA as outlined in this section.

5. Consent and Withdrawal

Your knowledge and consent are required for the collection, use, or disclosure of your personal information, except where permitted or required by law.

Implied Consent for Services: When you request a quote or engage us for a land clearing service, we imply your consent to collect, use, and disclose your personal information to the extent necessary to fulfill that service.

Express Consent for Marketing: We will obtain your express consent (e.g., through a clear checkbox on a web form) to receive electronic commercial messages (e.g., emails or text messages) regarding our services, promotions, or updates.

Withdrawing Consent: You may withdraw your consent for future use of your personal information at any time, subject to legal or contractual restrictions and reasonable notice, by contacting our Privacy Officer. This may, however, limit our ability to provide certain services to you.

6. Security Safeguards

We take reasonable steps to protect personal information against loss, theft, and unauthorized access, disclosure, copying, use, or modification. These safeguards include:

Technical Measures: Password-protected systems, encryption, and secure connection protocols (e.g., SSL) for online transmission.

Organizational Measures: Restricting access to personal information to only employees and contractors who require the information to perform their duties.

7. Access and Correction Rights

You have the right to request access to the personal information we hold about you and to request corrections to that information if you believe it is inaccurate or incomplete.

Requesting Access: Please submit a written request to our Privacy Officer. We will respond to your request within 30 business days, except where the Act permits or requires us to decline access.

Correction: If you demonstrate that the information we hold about you is inaccurate or incomplete, we will amend the information as required.
